Hello and welcome to Fixezi-The App of All Trades, There is a lot to read, but should only take 5-10minutes. We review every trade person, and will only activate their accounts if they provide all the information we require, we do not want to have unreliable tradespeople on our app, as that ruins our company name and reputation. We appreciate every person that joins our app and we want it to be the app of choice for when you need to book a tradesperson or receive work. We have worked very hard on Fixezi-The App of All Trades and have designed it with good intentions for both audiences(The user -the one booking a trade, and the trades person-the one receiving a job)and we have many more exciting developments for this app in the future that will help with the maintenance of homes/businesses, we want Fixezi to be the app you want to use and love to use-and we hope you can think of it as a trusted place to go to find great reliable and trust worthy qualified trades. We also would like you to inform us if you ever find any problems in using this app and instead of ignoring the issue or deleting the app, we would really appreciate if you could please send us an email of the issue in your 'profile menu -top right of the main (after you login ) then select the folder 'What do you think about Fixezi, now in saying that, we do not want to be flooded with bad reviews or bad content and we want you to remember on your signup we have your phone number and email so any accounts that abuse your privileges will be terminated and on that note every individual that signs up is responsible for their own account. Please acknowledge this announcement: We provide you with video tutorials on how to use Fixezi app in your register email we send you, and it’s important for you to understand that when you book a tradesman and decide you no longer need them to come to your property -YOU MUST CANCEL THE JOB BEFORE THE TRADE ARRIVES-do not leave it within 2hrs or less of the trade arrival. Also, its very important for you (the account holder) to know and understand that you are the one who will pay the trades person (payment you make to the tradesman has nothing to do with Fixezi) upon sign up we ask you to verify your phone number and your email so if you abuse your account, it will be terminated-and you will not be able to sign up again. Please don’t disrespect Fixezi-The App of All Trades or the trades people listed in fixezi app. Thanks User warning-During the COVID-19 pandemic; Fixezi-The App of All Trades is taking additional steps to make sure everyone can stay healthy and safe when a tradesman visits any home. Any person using Fixezi-The App of All Trades is to inform any tradesman well in advance if anyone in your household is unwell, or self-isolating because they are at risk of becoming unwell, with COVID-19. Unfortunately, due to strict public health requirements, all tradesmen will not be able to attend if anyone in your household is unwell or in self-isolation. We will of course treat this information in strict confidence and you can rebook the appointment for another time.

Please read these Terms and Conditions ("Terms", "Terms and Conditions") carefully before using the fixezi.com.au website and the Fixezi-The App of All Trades mobile application (the "Service") operated by FIXEZI PTY.LTD ("us", "we", or "our"). Your access to and use of the Service is conditioned on your acceptance of and compliance with these Terms. These Terms apply to all visitors, users, and others who access or use the Service. You warrant that you are at least 18-years-old and you are legally capable of entering into binding contracts. If you are under 18-years-old, you warrant that you have obtained consent from your parent or guardian and they agree to be bound by these Terms on your behalf. By accessing or using the Service you agree to be bound by these Terms. If you disagree with any part of the terms then you may not access the Service. Accounts

When you create an account with us, you must provide us with information that is accurate, complete, and current at all times. You are responsible for safeguarding the password that you use to access the Service and for any activities or actions under your password, whether your password is with our Service or a third-party service. You agree not to disclose your password to any third party. You agree to be fully responsible for activities that relate to your account or your password. You must notify us immediately upon becoming aware of any breach of security or unauthorized use of your account. You may not use as a username the name of another person or entity or that is not lawfully available for use, a name or trademark that is subject to any rights of another person or entity other than you without appropriate authorization, or a name that is otherwise offensive, vulgar or obscene.

Users

This app requires the use of your current location, camera, and your personal details to be stored in-app and displayed only to tradesmen that accept your job. You agree that Fixezi-The App of All Trades shall (FIXEZI PTY.LTD) not be liable for any damages, including but not limited to any work done in your home or business which results in Theft, fire, flooding, Structural damage, or low-quality workmanship suffered as a result of using the Service and that we are only an advertising application to provide you with connections to tradesmen. At no time will FIXEZI PTY.LTD -Fixezi –The App of All Trades be mediation between the user and tradesman, or vise vs. All users of FIXEZI PTY.LTD -Fixezi-The App of All Trades agrees that they are solely in charge of their own account and are liable to pay for any cost related to the work/quote the tradesperson has provided as listed on the advertising service of Fixezi-The App of All Trades. It is up to the user to pay the tradesmen after each job, or the tradesman to ask for payment from the user. FIXEZI PTY.LTD -Fixezi-The App of All Trades does not have a system in place to receive payment from the user unless otherwise informed by Fixezi-The App of All Trades.

Tradesmen

Fixezi-The App of All Trades is a trade-based advertising application for home/business and property owners looking for qualified reliable tradesmen, after a user has booked a tradesman and the tradesman accepts the job the tradesmen will then have complete scheduling control over the job. All users of Fixezi-The App of All Trades agree that they are solely in charge of their own account and are liable to pay for any cost related to the work/quote the tradesmen has provided as listed on the advertising service of Fixezi-The App of All Trades. It is up to the user to pay the tradesmen after each job, or the tradesman to ask for payment after each job. Fixezi-The App of All Trades does not have a system in place to receive payment from the user unless otherwise informed by FIXEZI PTY.LTD -Fixezi-The App of All Trades. Fixezi-The App of all Trades will have a rating system in place, each tradesperson used by a user will be rated on their performance. The rating categories are: Efficiency, Workmanship, Price There will be 3 strike rule-meaning tradesmen that fall below a rating of 2 stars in all 3 categories will be notified (in-app or via phone) of the standards of FIXEZI PTY.LTD -Fixezi-The App of all Trades, requires you to lift your standards of work ethic, otherwise, you may be subject to dismissal from Fixezi- the App of All Trades. We will give you 3 attempts to regain your ratings-which essentially is 9 separate jobs in which a user will rate your company. We understand that this could be unjust if a user were to put a bad rating on your company for any reason and that will be taken into consideration and no unjust action will be taken unless deemed fit to do so.

Pricing

All qualified tradesmen who agree to sign up, activate, and associate their company with FIXEZI PTY.LTD -Fixezi- the App of All Trades, agrees to our prices that are clearly displayed in tradesmen signup, company profile-Payment plan under our app-Fixezi- the App of All Trades. The fixed payment option will be ‘Pay per Job’ and ‘hit the ground running ‘the tradesmen will be responsible to pay a small fee to FIXEZI PTY.LTD -Fixezi- the App of All Trades in acceptance for the user’s job and personal details. FIXEZI PTY.LTD -Fixezi- the App of All Trades has no hidden fees. Prices may be subject to change after 12 months and any changes will be notified 30 days in advance. All tradesmen must ensure his/her ABN and contractor legal license number is displayed in the uploaded services you provide if applicable. Failure to do so may involve instant dismissal from Fixezi- the App of All Trades. If you as a tradesman have any doubts about listing your contractor license number, here is a link you can check. To check your contractor license details, click here: www.licencerecognition.gov.au In regards to 24 hr. emergency callouts, if you receive a job from any user for an emergency call out, you will have to contact that user immediately to inform them of your charges. All tradesmen reserve the right to refuse any job from any user. At no time will FIXEZI PTY.LTD -Fixezi –The App of All Trades be mediation between the tradesman and user, or vise vs.

Intellectual Property

The Service of Fixezi –The App of All Trades and its original content, features, and functionality are and will remain the exclusive property of FIXEZI PTY.LTD and its licensors. The Service is protected by copyright, trademark, and other laws of both the Australia and foreign countries. Our trademarks and trade dress may not be used in connection with any product or service without the prior written consent of FIXEZI PTY.LTD. Nothing in these Terms constitutes a transfer of any Intellectual Property rights from us to you..

Termination

Fixezi –The App of All Trades may terminate or suspend your account immediately, without prior notice or liability, for any reason whatsoever, including without limitation if you breach the Terms. Upon termination, your right to use the Service will immediately cease. If you wish to terminate your account, you may simply discontinue using the Service. All provisions of the Terms which by their nature should survive termination shall survive termination, including, without limitation, ownership provisions, warranty disclaimers, indemnity, and limitations of liability. We shall not be liable to you or any third party for any claims or damages arising out of any termination or suspension or any other actions taken by us in connection therewith. If applicable law requires us to provide notice of termination or cancellation, we may give prior or subsequent notice by posting it on the Service or by sending a communication to any address (email or otherwise) that we have for you in our records

Indemnification

As a condition of your access to and use of Fixezi –The App of All Trades, you agree to indemnify us and our successors and assigns for all damages, costs, expenses, and other liabilities, including but not limited to legal fees and expenses, relating to any claim arising out of or related to your access to and use of the Service or your breach of these Terms and any applicable law or the rights of another person or party. This indemnification section survives the expiration of your registration and applies to claims arising both before and after the registration ends.
